General terms and conditions of sale – Online ticket office – Abbaye Saint-Germain
The translation of the Abbaye Saint-Germain General terms and conditions of sale was made to facilitate the understanding of these GTCS, but cannot have any legal value.
1/ General points
These General Terms and Conditions of Sale (GTCS) apply to all online orders for one or several services purchased by the client from the Abbaye Saint-Germain online ticketing service www.abbayesaintgermain.tickeasy.com.
These services for dated tickets may only be used for the day(s) chosen by the client when the order was placed. These GTCS are available on the website.
The client states he/she has the capacity to conclude this contract.
Placing the order implies express, unreserved acceptance by the client of all the clauses and conditions laid down in these GTCS. Consequently, the client states and recognises he/she has full knowledge of the latter and therefore waives the right to avail of any other document.
The Abbaye Saint-Germain reserves the right to unilaterally change these GTCS at any time and to apply them to all orders placed after the date of any such change.
2/Orders
Orders for services are subject to these GTCS and to the Abbaye Saint-Germain visitor regulations.
To place an order, each client must be identified, having first created a secure account using a login and a password. Before confirming an order, the client has the possibility to check his/her choice and may change it if required.
When ordering dated tickets, the client is asked to check the date and time reserved.
The order will not be confirmed before the second and last confirmation of the order summary screen.
Once the order is confirmed, the client will automatically be redirected to a page confirming final validation. The client will also receive a confirmation email in which the Abbaye Saint-Germain acknowledges receipt of the client’s order. By keeping and/or printing this email, the client has proof of his/her order, which the Abbaye Saint-Germain advises the client to keep.
The tickets purchased will be sent to the client by email, in a PDF file. The tickets will also be made available to the client in his/her account. The client account is accessible after identification using the login and password.
Before arriving at the entrance of the Abbaye Saint-Germain, the client must print the E-tickets that were purchased online. The client also has the possibility to save a picture of the tickets on a smartphone, these tickets will be scanned at the ticket check point.
All the information in the confirmation emails will be considered as accepted by the client if he/she does not contest them by registered letter with acknowledgement of receipt within 8 days. However, they may only be contested if they differ from the reservations.
Pursuant the French Consumer Code, the client does not benefit from withdrawal period.
3/Rates
The applicable rates are those in effect on the date the order is placed. The Abbaye Saint-Germain reserves the right to change its rates at any time. Tickets rates are indicated in euros and including all taxes.
The client is aware of the reduced or free rates that he could pretend to. Proofs are requested to benefit from those reduced and free rates. If no such proof can be shown at the entrance, the client could not access to the services purchased. Unless he/she pays the supplement to reach the full rate (subjected to availability of those services).
A client who paid a full rate, even if he could pretend to reduced or free rates, cannot ask for repayment.
The only method of payment accepted under these general terms and conditions of sale for online ticketing is the bank card.
4/ Means of access
The entrance in the Abbaye Saint-Germain is free.
If the client wants to attend to a guided tour or others not free services, he/she has the obligation to book a ticket on the online ticketing service or at the Abbaye Saint-Germain reception. Clients are asked to arrive at least 5 minutes before the beginning of the event.
To ensure the visitors security, the Abbaye Saint-Germain apply all the measures decided by the government for the public administrations. All persons must lend themselves to the security checks.
The Abbaye Saint-Germain reserves the right to refuse access to every person which attitude, behaviour or outfit may create troubles inside the monument or disturb the visitors. In this case, no repayment could be asked by the client.
5/Obligations of the parties
The Abbaye Saint-Germain undertakes to deliver the services ordered, subject to compliance of the client with the procedure laid out in these GTCS
In the event where, after final confirmation of the order, the Abbaye Saint-Germain is unable to fulfil its obligations, in order to guarantee so far as possible a product complying with the client’s expectations, the Abbaye Saint-Germain reserves the possibility of changing the initial allocation of the services, provided that the latter correspond to the client’s expectations. In this case, the Abbaye Saint-Germain, must inform the client of any changes in a timely manner.
All visitors must comply with the visitor regulations displayed at the entrance to the Abbaye Saint-Germain. The visitors undertake to comply with any instructions issued by the Abbaye Saint-Germain concerning the organisation of services.
6/Responsibilities
The Abbaye Saint-Germain may wave part of all of its responsibility by proving that non-fulfilment or poor fulfilment of the contract is attributable either to the client, to the unforeseeable and unavoidable act of a third party with no relation to the provision of any services laid out in the GTCS, or to an act of force majeure as defined in the French law.
The client will be liable for any direct or indirect damage he/ she may cause during his/her visit to the Abbaye Saint-Germain, either to the staff and/or clientele of the abbey, or to any material made available to the client by the abbey.
The Abbaye Saint-Germain can in no case take responsibility in case of loss or robbery.
7/ Cancellation / changes
Dated tickets cannot be taken back or exchanged, except when a show is cancelled and the organiser decides to refund tickets. When the organiser decides to refund tickets, refunds will only be made to the initial purchaser in return for tickets.
Tickets are not subject to a withdrawal period.
The Abbaye Saint-Germain reserves the right, without payment of any compensation or penalty, to cancel the provision of services and change its program if an act of force majeure or fortuitous events obliges it to do so.
8/Applicable law, claims and legal disputes
These GTCS are subject to French law.
Any claims, regardless of their type, must be sent in writing to the Abbaye Saint-Germain, at latest on the day of visit. The letter must specify the order number and the precise reasons for which the said claim is being made, and be sent to the following address: Abbaye Saint-Germain, 2 bis Place Saint-Germain, 89000 Auxerre.
Should there be difficulty interpreting or applying these conditions, the parties will try, in so far as possible, to settle their dispute amicably. Any disputes that may arise from these sales conditions must be referred, even in the case of multiple parties or activation of the guarantee, to the competent court in the jurisdiction of the Abbaye Saint-Germain head office.
9/Personal data
The information collected for online ticketing is intended for the Abbaye Saint-Germain. It is used in the processing of the client’s request and commercial management of it by the Abbaye Saint-Germain, in particular:
-replies to information requests on the website,
-placing and management of orders
-forwarding commercial information when the client has agreed to this,
-when permissible under current legislation, compilation of general statistics on consultation of the website in order to improve the services offered by the Abbaye Saint-Germain on this website.
In compliance with French law n°78-17 of January 6th, 1978 on Information Technology and Protection of Privacy, the client has the right to access, rectify or eliminate information about him/her, and can exercise this right by contacting the Abbaye Saint-Germain, whose head office is located at 2 bis, Place Saint-Germain, 89000 Auxerre – abbaye.saintgermain@auxerre.com, which is responsible for processing information. This in an individual right that can only be exercised by the person in question regarding his/her own information: for security reasons, the Abbaye Saint-Germain must check the client’s identity in order to avoid communicating any confidential information concerning him/her to another person.
Fields in the registration forms followed by an asterisk must be filled out. Failing this, the Abbaye Saint-Germain cannot take the registration request into account.
